Participation Terms

These terms explain how the portrait photograph you send is used, for how long, how you can withdraw it, and what the certificate you receive is and is not. Please read them before you send a photograph.

01What you are joining

ONE HEART is a participatory mosaic art project. Twenty-three artworks are assembled from portrait photographs sent by the people taking part. Each portrait becomes one piece of one artwork and stays in the position it is given. An artwork is finished only when every place in it is filled.

By sending a photograph you agree to these terms. They are between you and TAmJ Inc., which runs the project.

02How your photograph is used

Your photograph is used only as a piece of the artworks you have joined, and in images of those artworks. This includes:

Your photograph itself is not edited, retouched or altered, and it is not used on its own, outside an artwork, for any purpose.

This permission covers merchandise. Products made from an artwork necessarily contain every piece in it, including yours. By taking part you grant that use for the artworks you join. If you are not comfortable with this, please do not send a photograph.

03Your face remains recognisable

Each portrait is small within a finished mosaic, but it is not blurred, abstracted or reduced to colour. It remains a recognisable photograph and can be seen when the artwork is viewed up close or at high resolution.

Please send a photograph you are comfortable having shown inside a public artwork.

04Term

The permission above has no end date. The artworks are intended to be permanent works, and a piece cannot be removed from an artwork once that artwork has been completed and delivered without destroying it for everyone else inside it.

Section 06 sets out what you can do before and after an artwork is finalised.

05We do not give your photograph to anyone else

We do not sell, license, rent or transfer your photograph to any third party for any purpose other than producing and presenting the artworks you have joined.

We use service providers for hosting, storage and delivery. They process the files only on our instruction and only for those tasks. We do not use your photograph to train facial recognition systems or any other machine learning model, and we do not permit others to do so.

06Withdrawing your photograph

Before the artwork is finalised. You can ask us to remove your photograph at any time. We will remove it and your place will be filled by another participant. Contact info@tamjump.com with the name and email you used to take part.

After the artwork is finalised and delivered. The finished image cannot be altered, because it exists in the hands of everyone else inside it. From the date we receive your request we will stop using your photograph in any new material, and we will not include the artwork containing it in new merchandise or new reproductions. Material already produced, and copies already delivered to other participants, remain as they are.

Withdrawing does not entitle you to a refund of your pledge, and your certificate for that piece ceases to be valid.

07Photographs of people under 18

A Kickstarter account holder must be an adult, so the pledge is always made by an adult. These terms apply where the person shown in the photograph is under 18.

After the campaign closes, the participation survey asks you to state whether the person in the photograph is under 18. If you answer yes, you are asked for the name of their parent or legal guardian, your relationship to the person shown, and to confirm the following:

A portrait of a person under 18 is not used unless that confirmation has been given. Your survey response is kept as the record of consent. A parent or guardian may ask for the portrait to be withdrawn at any time under section 06.

08The photograph you send

By sending a photograph you confirm that you are entitled to send it and to grant the permission in section 02. In practice that means:

We may decline a photograph that is unsuitable for a public artwork, that is not a portrait, or that we have reason to believe was sent without the consent of the person shown. If we decline a photograph we will ask you for a replacement.

09Storage, retention and deletion

Photographs and participation records are stored on cloud infrastructure operated by established providers, with access limited to the people running the project.

We keep the original file for as long as it is needed to produce, reproduce and reissue the artworks it belongs to, and to verify certificates. We keep your name or initials, the pieces you hold and your member ID for as long as your certificates remain valid.

You may ask us for a copy of the personal information we hold about you, for it to be corrected, or for it to be deleted. Deletion of your account record is carried out subject to section 04 and section 06: we can stop new use of your photograph and delete the stored original, but we cannot remove a piece from an artwork that has already been completed and delivered. 10What your certificate is

For every piece you hold you receive a certificate recording the artwork, your piece number and its position, and a certificate ID that can be verified. Every certificate you hold is linked to a single member ID.

A certificate is a record of participation. It carries no financial return, no ownership share in any artwork or in TAmJ Inc., no revenue interest, no dividend, no voting right and no guaranteed resale value. It is not a security, and it is not an investment.

Recognition described elsewhere in the project — early access to merchandise, priority places in future ONE HEART projects, invitations to public exhibitions — applies only if and when such merchandise, projects or exhibitions actually happen. These are intentions, not commitments, and they are not rewards of the Kickstarter campaign.

Copyright in the finished artworks belongs to TAmJ Inc. You keep all rights in your own photograph; you grant the use described in section 02 and nothing more.

11Delivery

The campaign is digital. Artworks, certificates and member IDs are delivered electronically. Nothing is shipped physically.

An artwork is produced once all of its places are filled. Dates given during the campaign are estimates. If an artwork you have joined does not reach the number of portraits it needs, we will contact you before production and you may move your place to an artwork that is going ahead.

12Changes to these terms

We may update these terms — for example to reflect how the project develops after the campaign. If a change materially affects how your photograph is used, we will notify participants by email and through a Kickstarter update before it takes effect, and you may withdraw under section 06 if you do not accept it. The effective date at the top of this page always shows the current version.

13Governing law

These terms are governed by the laws of Japan. Any dispute arising out of them is subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

Nothing here limits any right you have under the mandatory consumer or data protection law of your own country.
